This is a continuation of our page on Globally Reported Tobacco Industry Interference during COVID-19 Pandemic and summarises the incidents reported during the month of October 2021. This page will be continuously updated as and when incidents related to the respective month are reported.

The Summary of Interference Reported as of 31st October 2021

Week 82: 4th October – 10th October 2021

  • Sanjiv Puri, Chairman and Managing Director of ITC Limited India spoke on the role of cooperate sector in addressing the challenge of climate change at the India Today Conclave 2021, where experts in different fields shared their experiences. He further mentioned that ITC has employed strategies to overcome climate change. [1]
ITC Limited India is the main tobacco company in India, which had diversified their business into other ventures. Plethora of evidence have revealed that cigarettes and its manufacturing process negatively impact the environment including global warming and climate changes, thus, the human health.
  • Swedish Match, tobacco and nicotine product manufacturer based in Sweden, announced that they plan to sell their combustible tobacco business, reportedly, to become “the first smoke free tobacco brand” in the world.[2]
  • Media reported that Fontem Ventures, a subsidiary of Imperial Brands, is piloting a new marketing campaign for ‘Blu’, their e-cigarette product, in Charlotte, North Carolina.[3]
  • Philip Morris International (PMI) announced initiation of a partnership with Arizona Chamber of Commerce to “protect” United States from illicit cigarette trade. It further mentioned that Arizona is among the worst states in the US for illicit trade (Image 1).[4]

  • Trade associations including National Association of Convenience Stores, the association for convenience and fuel retailing in the United States, wrote a letter opposing increase of tobacco price. The letter stated that illicit cigarette trade would increase and youth would be targeted if the prices of tobacco products increase. It further mentioned that the trade associations are backed by the tobacco industry, though the names of the individual companies had not been stated in the letter.[5]
This is a common counter-response by the tobacco companies to evade potential tobacco tax increases. It is also common to see involvement of front groups in these responses. Tobacco companies are known for their involvement in the illicit trade in many parts of the world. Article 5.3 of Framework Convention on Tobacco Control (FCTC) recommends the governments not to have any partnership with the tobacco industry. Such partnerships have a fundamental irreconcilable conflict of interest with public health.
  • Media reported the seize of illicit cigarettes worth of Peso 32 million at Balagtas town, Philippines. Representatives of Philip Morris Fortune Tobacco Corporation (PMFTC), a joint venture between Fortune Tobacco Company (FTC) and Philip Morris International (PMI) in Philippine, and Japan Tobacco International (JTI) Philippines also reportedly participated in this operation.[8]

  • SettleMint, a global Blockchain technological company based in Belgium, officially announced that they ended the pilot project with ITC Agri Business, which started in 2019.[9] ITC Agri Business is one of the diversified business categories of ITC Limited India, the main tobacco company in India.
  • The Uttar Pradesh State Industrial Development Authority (UPSIDA) has initiated a project in the food processing sector with national and international investors. ITC Limited India has reportedly invested INR 800 crores to establish the suggested food processing unit in a 60-acre-area allotted by the government.[10] ITC Limited India is the main tobacco company in India, which had diversified their business into other ventures. FCTC Article 5.3 recommends governments not to enter into partnerships with the tobacco industry.

Week 83: 11th October -17th October 2021

  • Organized Crime and Corruption Reporting Project (OCCRP), a global network of investigative journalists exposing crime and corruption in the world, reported that there is an increase in the illicit cigarette trade in Latin America. They reported the presence of brands of China National Tobacco Corporation (CNTC) among the illicit cigarettes while pointing out that only Chile has a legal cigarettes market for CNTC brands. Media reports further disclosed that a subsidiary network of CNTC either import or manufacture Chinese cigarettes within a Free Trade Zone in Panama. They also reported that the tobacco company PMI had estimated 22% of cigarettes in the American continent to be illicit.[11]
  • British American Tobacco (BAT) France (BATF) was convicted of illegal advertising of vaping products on their website as per the confirmation of the order by the Versailles Court of Appeal in France. Initially, the decision was given by the Nanterre District Court against the promotive nature of content on ‘Vuse’ products on the BAT website.[12]
  • Suresh Kumar Shah, the Chairman of Ceylon Tobacco Company PLC (CTC), was appointed as the chairman of Providore shop, an online grocery and household products marketplace in Sri Lanka. As of November 2021, cigarettes are not available in Providore shop for online sales. [13]
Though the National Authority on Tobacco and Alcohol (NATA) Act, the main legal framework for tobacco control in Sri Lanka, does not specifically prohibit the online cigarettes sales, online cigarette sales were not common in Sri Lanka, before COVID-19 pandemic related lockdowns.
  • Japan Tobacco International (JTI) reported a surge of illicit trade to 6.8% in the first quarter of 2021 compared to same period in 2020. It further reported that Mindanao Island showed the highest prevalence of illicit trade among islands in Philippines.[14]

Week 84: 18th October - 24th October 2021

  • The US Food and Drug Administration (FDA) granted approval to British American Tobacco (BAT) to continue the trade of its e-cigarette product Vuse Solo in the United States. It is recorded as the first e-cigarette brand to be approved to be sold in the US. The approval does not cover the flavored products under this brand.[18]
  • Altria announced that they are planning to stop trading heated tobacco products in the United States from 29th November 2021. This followed the judgment made by the International Trade Commission (ITC) against Altria on violations of two patents owned by Reynolds tobacco company, a subsidiary of British American Tobacco (BAT), in May 2021.[19]
  • An open letter signed reportedly by a group of “experts in nicotine science and policy” was sent to Parties to the Framework Convention on Tobacco Control (FCTC) aiming the 9th Conference of the Parties (COP) scheduled to be virtually held in early November. The letter requested to change the “anti-vaping stance” of the World Health Organisation (WHO). Signatories to the letter included Emeritus Professor Wayne Hall at the National Centre for Youth Substance Use Research at the University of Queensland and Emeritus consultant Dr Alex Wodak of St Vincent’s Hospital as reported by media (Image 3).[20]

  • Vassilis Vovos, Chief Financial Officer (CFO) of Japan Tobacco International (JTI), will address the ‘The Greeks Are Back’ conference organised by the Public Affairs & Networks to be held on 21st October 2021. Public Affairs & Networks is a consulting firm that provides services to foreign multinational and large local companies operating in Greece. Conference reportedly focuses on ‘how the country can improve its attractiveness as an investment destination’. Media further reported that the JTI is listed as a supporter to the conference. [21]
  • The Chief Executive Officer, Will Downie, and the Chief Financial Officer, Paul Fry, of Vectura sold their shares worth of £ 2.3 million and £ 3.8 million respectively to Philip Morris International (PMI). PMI purchased Vectura, a pharmaceutical company based in UK that develops inhaled therapies, in August 2021. Media reported that this sale of shares is part of the same deal .[22]
  • Btomorrow Ventures (BTV), the cooperate venturing arm of British American Tobacco (BAT), invested $ 3.5 million in ‘Tru’, a company based in Massachusetts, United States, that manufactures energy and wellness drinks.[23]
  • Philip Morris International (PMI) will be awarded the Excellence in Environmental Protection at the Geospatial World Forum 2022 scheduled to be held in May 2022 at the Netherlands. Geospatial World Forum reportedly aims to “recognise contributions in the geospatial field by awarding innovation and excellence”.[24]

  • Medicago, a biotechnological company partially (25%) owned by Philip Morris International (PMI), is to introduce a first plant based COVID-19 vaccine in the world. The Canada based company reports that the vaccine is cheaper and easy to manufacture, though plant-based vaccines are not yet approved for human use.[25]
  • Philip Morris International (PMI) in Switzerland has sponsored Geneva Pride 2021, a series of events to celebrate the lesbian, gay, bisexual, transgender and queer (LGBTIQA+) movement, held from 8 to 12 September 2021. PMI was awarded the ‘Swiss LGBTI Label’, a certification awarded to companies and organisations with an “open and inclusive” structure, for the year 2021. This is awarded by the Swiss LGBTI Label, a non-profit organisation reportedly “committed to a diverse and inclusive culture in the workplace”.[26]
  • Philip Morris International (PMI) reported a 20.4 million increase of heated tobacco products users at the end of the third quarter of 2021, of which 14.9 million were users switched from smoking. They further mentioned that the revenue from heated tobacco products represents around 28.6% of the total revenue of the company.[27]
  • Altria Group Distribution Company (AGDC) declared that they sponsored ‘TruAge’, a new age verification system developed by the National Association of Convenience Stores (NACS), the global trade association that represents the convenience and fuel retailing industry.[28]

Week 85: 25th October - 31st October 2021

  • Philip Morris International (PMI) declared that they are prioritizing current users over the new users due to unavailability of adequate IQOS devices, the heated tobacco product of PMI. This statement was in response to the limited availability of heated tobacco products reportedly because of shortage of semiconductors in the market.[29]
  • Ignazio Suarez, the head of Scientific Engagement of Philip Morris International (PMI), promoted heated tobacco products at a media conference in Nigeria stating those are less risky and less toxic as per their research findings.[30]
Tobacco industry is known for producing its own “evidence” to manipulate the science related to the public health policies.
  • Jacek Olczak, Chief Executive Officer (CEO) of Philip Morris International (PMI), was accused of lobbying the UK government on the acquisition of Vectura, a pharmaceutical company that develops inhaled therapies. Olczak has written a letter to Kwasi Kwarteng, the Secretary of State for Business, Energy and Industrial Strategy of the UK government, requesting a meeting.[31]

  • A research study conducted on approximately 200,000 adolescents in United States and Canada, revealed that marijuana vaping has doubled during the period of 2013 – 2020 and the preference of product has shifted from dried marijuana to cannabis (CBD) oil. This trend was assumed to be due to the industry propagated misconception of CBD vaping being less riskier compared to smoking.[32]
  • Federal Trade Commission (FTC) announced a 0.4% surge of cigarettes sales from 202.9 billion to 203.7 billion cigarettes in 2020 for the first time in past 20 years based on the data provided by four tobacco companies; Altria Group, ITG Holdings USA, Reynolds American and Vector Group Ltd. FTC further reported an increase of the advertising and promotion budget of the companies from $7.624 billion to $ 7.84 billion during the same period.[33]
  • Lobin Lowe, Minister of Agriculture in Malawi, visited the Japan Tobacco International (JTI) Leaf factory and stated that considering Malawi as a tobacco processing country is the key to a better future. He further requested for continuous support of the tobacco buyers to keep up the interest of farmers (Image 4).[34]
Tobacco companies are well known for their involvement in lobbying politicians, policymakers and high rank officials in order to gain leverage in interference in tobacco control actions and policies and also to whitewash the image of the industry. Scientific evidence reveals that tobacco cultivation negatively impact the environment, social economic development and the farmers’ health causing illnesses like Green Tobacco Sickness syndrome, skin disorders, respiratory disorders and psychiatric disorders.

  • Media reported that all factories and hotels of ITC Limited India has obtained the Alliance for Water Stewardship (AWS) certification, the global benchmark for responsible water stewardship, becoming India’s first AWS certified company.[35]
  • Philip Morris International (PMI) introduced its Low Carbon Transition Plan (LCTP), which reportedly details how to achieve climate targets by reducing carbon emissions and greenhouse gases by 2040.[36]

  • Philip Morris International (PMI) announced that they are planning to invest over USD 100 million in Otopeni factory in Romania to transform its combustible manufacturing unit to heated tobacco products. It further reported that PMI had already invested USD 500 million since the initiation of the transformation in 2017.[37]
  • Philippe Van Gils, head of illicit trade prevention of Philip Morris International (PMI), addressed the EMEA Security Conference held in Dubai on 27 and 28 October 2021. He stated that the illicit cigarettes can cause health issues and loss of potential tax revenue. According to its website, EMEA Security Conference “brings together Government Agencies and Brand owners to link them with Security Solution Providers to combat illicit trade and Counterfeiting”.[38]

  • Altria Group reported a decrease of revenue by 4.7% to USD Millions 6,786 during the third quarter of 2021, compared to the corresponding quarter in 2020. Further, it reported a 0.5% decrease in revenue in 2021 compared to 2020.[39]
  • Japan Tobacco International (JTI) announced an increase in revenue by 10.6% and 10.9% during the third quarter and the period of the first nine months in 2021, compared to the corresponding periods in 2020.[40]
  • ITC Limited India declared a surge of net profit to Rs 3,697.18 crore during the second quarter of 2021, which was 13.67% increment compared to the same period in 2020. It further reported a recovery of cigarette sales volume in this quarter nearly to the pre-pandemic level.[41]
  • British American Tobacco (BAT) Nigeria praised the Manufacturers Association of Nigeria (MAN), reportedly for continuous support for the development of manufacturing sector in Nigeria at its 50th Anniversary celebration conference. MAN is established as a company limited by guarantee to promote and protect manufacturers interest according to their website.[42]
  • Nedal Salem, Managing Director of British American Tobacco (BAT) in Malaysia, praised the government for introducing excise tax on all vaping products containing nicotine, following the tabling of government budget for the year 2022. Salem further urged to cautiously introduce the tax policy, which could mislead the users to cheaper and unregulated products in the black market making the government lose the tax revenue.[43]
It is common to see illicit tobacco trade to be referred to in responses of the tobacco industry on tax issues.
  • Media reported that the US Food and Drug Administration (FDA) is in the process of final stage of reviewing of premarket tobacco applications (PMTA) to sell tobacco products in the United States. As per the FDA, the applications for 200,000 products had been rejected and applications for nearly 80,000 products are under pending approval while only three applications were approved so far.
